1 About

1.1 – The AKCGlobal Group is made up of AKCGlobal Ltd, a UK (England and Wales) registered company limited by shares (Company Number 9178409), and AKCWorldwide CIC, a UK (England and Wales) registered not-for-profit social enterprise limited by guarantee (Company Number 9730131) which is wholly-owned by AKCGlobal Ltd. The AKCGlobal Group may also refer to additional companies registered in the UK (England and Wales), United States (US) or elsewhere globally in which AKCGlobal owns a share, is a Director of, or has incubated and is supporting (including providing office space, equipment, access and support) at its registered or subsidiary addresses, including any contracted through its ‘AGORA’ services.

The AKCGlobal Group (and each of its constituent companies) may be referred to or trade as ‘AKCGlobal’, ‘AKCG’, ‘AKCG (EU)’, ‘AKCG (UK)’, ‘AKCG (US)’, ‘AGORA Member’, ‘AKCGlobal Group Company’, ‘We’, ‘Us’, ‘Website’, ‘the company’, ‘the consultancy’, and any such terms include our employees, subsidiaries, independent contractors, agents, attorneys, owners, and assigns.

We primarily provide consultancy services, acting in an educational, advisory and executive role on both a per-project and retainer basis. We also offer additional solutions to our clients, including (but not limited to) interim management/recruiting/placement, representation and distribution of other companies’ products and services in the UK and European Union (EU), and UK business incorporation and incubation services and support.

You may be referred to as the client. The terms ‘You’, ‘the client’, ’the contractor’, ‘the buyer’ or ‘individuals’ includes you and any of your employees, partners, independent contractors, subsidiaries, affiliates, attorneys, agents, owners, heirs, and assigns. Agreements, including use of this website or information transmitted through it, are made and set out between You and AKCGlobal and governed by the laws of the United Kingdom (England & Wales).

2 Disclaimers

2.1 – All content is provided “as is” and any and all warranties are disclaimed, whether express or implied, including, without limitation, any implied warranties of merchantability or fitness for a particular purpose. The use of our information, products and services should be based on your own due diligence.

2.2 – Unless explicitly amended by a separate and legally-executed contract, our cumulative liability to you or anyone else for any loss or damages resulting from any claims, demands, or actions arising out of or relating to this Agreement or use of the content or website shall not exceed the amount you have paid to us for the product or service. In no event shall we be liable for any indirect, incidental, consequential, special, or exemplary damages or lost profits, even if we have been advised of the possibility of such damages. If we break this Agreement, we will not be liable to you for losses and costs caused by abnormal or unforeseeable events, that we cannot reasonably control and which would have been unavoidable despite all reasonable efforts to prevent the event happening.

2.3 – You agree that the foregoing constitutes your sole and exclusive remedy for any breach of this Agreement, where such a limitation and exclusion of liability is permitted under the law.

2.4 – AKCGlobal uses cookies on this website to enable you to move about the site and provide you with information requested, as well as to enhance functionality of the website by storing your preferences and allowing you to potentially login to user accounts. Performance-enhancing cookies may also be used in order to provide a better user experience, with additional tracking cookies being employed to measure the effectiveness of the company’s marketing.

2.5 – You must be at least 18 years old to access this website or to purchase products or services from us. We do not specifically target this website to persons under eighteen, nor do we knowingly collect any personal information from children under the age of 13 (or 14 in the Republic of Korea).

3 Terms of Contract

3.1 – If you do not agree to the policies outlined on this page in whole or part you must immediately cease using the website and may contact AKCGlobal to seek remedy of the situation.

3.2 – You agree not to assign, sublicense, transfer, pledge, sell, lease, rent, lend, or otherwise copy the content, or any part of it, or share any aspect of your rights and responsibilities under this Agreement, to others. The individual consents not to share or give others access to any username and password to access AKCGlobal content or services. You are not authorised to sell any AKCGlobal or AKCGlobal-branded products or services from your site as a “reseller” and no “resale” rights are granted in any way on these products unless otherwise noted.

3.3 – You agree not to violate any laws, third party rights, or this Agreement. This includes, but is not limited to, not posting any material or content that is defamatory, harassing, belongs to someone else, is obscene or pornographic. You also agree not to provide false or misleading information to us.

3.4 – You agree to indemnify, defend and hold us harmless from and against all claims, demands, losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from your actions or conduct.

3.5 – Our failure to enforce any rights granted in this Agreement or to take action against any other party in the event of any breach shall not be deemed a waiver by us as to subsequent enforcement of rights or subsequent actions in the event of future breaches.

3.6 – This Agreement is entered into in London, England. In all respects this Agreement shall be governed by and construed according to the laws of England and Wales (United Kingdom), located within the European Union, to the exclusion of any other applicable body of governing law, without regard to conflicts of laws principles. You consent to the exclusive jurisdiction of England for any dispute arising from or related to this Agreement. AKCGlobal’s legally registered office is Studio 5 (TheCUBE), 155 Commercial Street, London E1 6BJ, UK. You agree that the exclusive venue for any dispute arising from or related to this Agreement will be located in England (United Kingdom). This Agreement and all communications between AKCGlobal and you concerning this Agreement shall be in English.

3.7 – Should any term of this Agreement be declared void or unenforceable, that term shall be severed from the Agreement such declaration shall have no effect on the enforceability of the remaining terms.

3.8 – This Agreement contains the complete and entire understanding and agreement between you and us and supersedes any previous communications, representations, or agreements, verbal or written, related to the subject matter of this Agreement. This Agreement may not be modified or amended orally, impliedly, or in any manner not set forth in writing as permitted by this Agreement (see section 8 entitled “Policy Changes”).

4 Privacy Agreement

AKCGlobal respects your privacy. This Privacy Statement informs you of our privacy practices and of the choices you can make about the way information about you and your online activity or communication is collected and how that information is used.

4.1 – External Services: AKCGlobal websites or services may provide references or links to third-party applications, products, services, or websites. These links will cause you to leave AKCGlobal controlled websites. We do not control the content or privacy practices of those third party sites and companies, whose policies may differ from AKCGlobal’s own practices. We neither endorse nor make any representations about third-party sites in this and other respects. The personal data you choose to provide to or that is collected by these third parties is not covered by AKCGlobal’s own Privacy Statement and we encourage you to review the policies of any site with which you interact with before allowing the collection and use of your personal information. AKCGlobal may also provide social media features that enable you to share information with your social networks and to interact with the company on various social media sites. Your use of these features may result in the collection or sharing of information about you, depending on the feature. We encourage you to review the privacy policies and settings on the social media sites with which you interact to make sure you understand the information that may be collected, used, and shared by those sites.

4.2 – The Information We Collect: AKCGlobal collects, exports, and uses a range of information to personalise your experience and interaction with the company. Such collection is done with appropriate notice and consent, in a manner consistent with the law. The information we collect may be used in a wide-range of activities, such as product or service activation, order processing and registration, profile creation, user verification, fulfilling information requests, updating you on services and benefits, personalising AKCGlobal websites, communicating with you about products or services, marketing commercial offers and promotions, providing customer support, measuring the efficacy of marketing initiatives, processing contest entries and contacting winners, collating survey information and in the process of hiring individuals. This list is not exhaustive and certain information is only ever used for the purposes of transaction processing and fraud prevention.

You may provide us with contact information, such as name, address, telephone number and email address, financial information, such as your banking or PayPal account details or other billing details as well as government-issued identification number and other data. Depending on your use of AKCGlobal services you may also be asked to create a user ID and password, or provide an existing user ID and password to login, either directly to AKCGlobal servers/websites or through third-parties such as Facebook, Twitter, Google, Yahoo! or secondary login solutions. You may provide us with your curriculum vitae, resume, work and other experience, product and service preferences, contact preferences, educational and employment background, job interest data, personal hobby information such as “likes” and “dislikes” either directly or through your use of third-party solutions to log in to AKCGlobal products or services. If you belong to a larger organisation, it is possible that your business contact details may be provided to AKCGlobal by a designated entity within your firm or enterprise (such as a member of your IT department) for the purposes of registration with AKCGlobal.

If you choose to use a “tell-a-friend” or a similar referral program on our site, you may be asked for your friend’s e-mail address, social media handle, phone number, or other contact information necessary to invite your friend to participate in AKCGlobal products or services.

In addition to the information you provide, AKCGlobal may also collect information during your visit to or use of AKCGlobal websites, internet-connected applications, or websites maintained or “powered by” another company on behalf of AKCGlobal. Such information may include your name, address, email address, preferences, interests, and demographic/profile data. The information AKCGlobal collects from its public or commercial sources may be used along with the information AKCGlobal collects when you visit or talk to AKCGlobal sites or representatives.

If you post, comment, indicate interest or complaint, or share identifiable personal information, including photographs, to any public forum on any AKCGlobal site, social network, blog, comment-box or other such platform viewable by others, please be aware that any information you submit may be read, viewed, collected, downloaded or used by other users of AKCGlobal websites, and could be used to contact you, send you unsolicited messages, or for purposes that neither you nor AKCGlobal have control over. AKCGlobal is not responsible for the personal information you choose to provide in these forums and wishes to highlight the risks associated with the disclosure of personally identifiable information on any publicly viewable platform.

4.3 – Consent to Use Information: When you communicate with us, send us information, submit your contact information and/or CV/resume for the purposes of possible employment or contracting, or provide content to us or our website, you grant AKCGlobal (including subsidiaries, other Members of the AKCGlobal Group, AGORA or other clients/members and their parent companies) a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise all copyright and publicity rights you have in and over the content, in any manner whatsoever, in or through any media now known or which may be created in the future, including in other works and forms not associated with this website.

4.4 – Disclosure of Information: AKCGlobal does not sell, rent or lease your personal information to others except as described in this Statement. AKCGlobal shares personal information only in the following ways:
AKCGlobal retains service providers and suppliers to deliver complete products, services and customer solutions and to assist AKCGlobal with marketing and communication initiatives. These providers and suppliers include, for example, credit card and payment processors, providers of customer support and live-help, marketing, email service providers, automated data processors, and shipping agents. Suppliers and service providers are required by contract to keep confidential and secure the information received on behalf of AKCGlobal and may not use it for any purpose other than to carry out the services they are performing for AKCGlobal. Such information-sharing may be necessary to ensure payment processing, product delivery and effective followup support;
Except as described above, AKCGlobal will not share the personal information you provide to the company with non-AKCGlobal third parties on any other occassion without your permission, unless to: (i) respond to duly authorised information requests of police and governmental authorities; (ii) comply with any law, regulation, subpoena, or court order; (iii) investigate and help prevent security threats, fraud or other malicious activity; (iv) enforce/protect the rights and properties of AKCGlobal or its subsidiaries; or (v) protect the rights or personal safety of AKCGlobal, our employees, and third parties on or using AKCGlobal property when allowed and in line with the requirements of applicable law;
AKCGlobal may transfer your personal information to other AKCGlobal-owned business entities in the UK, EU and Worldwide. By accessing AKCGlobal websites, products and services, submitting a CV/resume, registering your business’ contact details, registering for an account or service, or otherwise providing the company with your personal information, you consent to this transfer of your personal information throughout the global AKCGlobal network of entities. As we continue to develop our business, we or our affiliates may sell or buy other businesses or entities, or mergers may occur in which data is transferred. Whether for strategic or other business reasons, if the company decides to reorganise its businesses in such a way that may involve the disclosure of personal information to prospective or actual purchasers, or the receipt of it from sellers, AKCGlobal will seek appropriate protection for the information concerned;
Your information may be stored and processed in any country in which we maintain facilities or conduct operations. Due the nature of internet networks, your information may pass through multiple jurisdictions on its way to or from AKCGlobal. By using our website, products and services, you consent to any such transfer of information outside of your country. Should your account become inactive, your information may remain in our databases, computers, backups and archives.
4.5 – Opting Out of Communications: Subscription communications include email newsletters, SMS updates, software and “push” notifications, etc. that may be expressly requested by you or which you consented to receive in the course of entering personal information (for example, but not limited to your name, email, phone number or address) on a AKCGlobal product, service or website. After requesting such communications, you may opt out of receiving future communications by using one of the following methods:
Email unsubscribe: Select the email “opt out” or “unsubscribe” link, or follow the opt-out instructions included in each email subscription communication.
SMS unsubscribe: To unsubscribe from messages delivered to mobile devices by SMS, reply to the message with the words “STOP” or “END.”

Alternatives means of unsubscribing: sometimes it may be possible to return to the web-page(s) where you originally registered your preferences and follow the onscreen opt-out instructions there. Where this is not possible and individuals have already attempted to unsubscribe by the alternative means mentioned above (where applicable), users may contact AKCGlobal directly to ensure discontinuation of communications. Be sure to provide your full name, relevant contact information, and specific information regarding AKCGlobal subscriptions that you no longer wish to receive. 4.7 – Information Security: AKCGlobal takes information security extremely seriously and follows the best possible, industry-leading practices to ensure your safety and security online in line with the UK Data Protection Act of 1998. We take the trust you place in us very seriously, and to prevent unauthorised access or disclosure, to maintain data accuracy, and to ensure the appropriate use of information collected, the company utilises reasonable and appropriate physical, technical, and administrative procedures to safeguard the information we collect and process, retaining data only as required or permitted by local law and while it has a legitimate business purpose. You agree that your continued use of our product or service after that date will constitute your consent and acceptance of the amendment.
